Terms of Service

1. The Service

MyReminders helps you remember birthdays, anniversaries and other occasions, write messages (optionally with AI), and send them — automatically by email at the time you choose, or through WhatsApp or your phone with one tap. We keep improving the Service, so features may change; we will tell you before removing something you pay for.

2. Your account

• You must be at least 13 years old, or the minimum age required in your country.
• Keep your sign-in details secure and tell us at appsupport@desireinnovations.com if you suspect unauthorised access.
• You are responsible for activity on your account.

3. People you add and messages you send

• Only add people whose details you are allowed to store, and only message people who would expect to hear from you. You are responsible for having their consent.
• You are responsible for the content of your messages, including AI-written drafts you choose to send. Please review drafts before sending.
• You must follow the laws that apply to your messages (for example anti-spam and telemarketing laws) and the rules of WhatsApp, your email provider and mobile carriers.

4. Acceptable use

You may not use the Service to:

• send spam, bulk marketing, or messages to people who have not agreed to receive them;
• harass, threaten, deceive or impersonate anyone;
• send unlawful, hateful or sexually explicit content;
• interfere with, probe or overload the Service, or access it other than through our apps and published interfaces.

We may suspend or close accounts that break these rules.

5. AI-written drafts

When you ask for a draft, the details described in our Privacy Policy are sent to our AI provider (Groq, with Google’s Gemini API as a backup) to generate a suggestion. AI output can be inaccurate or inappropriate; it is a suggestion, and you decide whether to send it.

6. Free plan, paid plans and subscriptions

• The free plan has the limits shown on our pricing page and in the app. Accounts created on or before 31 December 2026 keep the early-bird contact allowance described there.
• Paid plans are subscriptions that renew automatically at the end of each period (monthly or yearly) at the price shown when you subscribe, unless you cancel at least 24 hours before the period ends.
• If you subscribe in the iPhone app, payment is charged to your Apple ID and the subscription is managed and cancelled in your App Store account settings. If you subscribe in the Android app, it is handled by Google Play and managed in Google Play settings. Refunds for those purchases are handled by Apple or Google under their policies.
• Deleting the app or your account does not cancel an App Store or Google Play subscription.
• If we change prices, we will tell you in advance and the new price will apply from your next renewal.

7. Apple and Google

If you use our iPhone app, these terms are between you and MyReminders, not Apple. Apple is not responsible for the app or its content, has no obligation to provide support for it, and is a third-party beneficiary of these terms who may enforce them against you. Your use of the app must also comply with the App Store’s Usage Rules. The same applies to Google for the Android app and Google Play’s terms.

8. Delivery and availability

We work hard to deliver every message on time, but delivery depends on networks and third-party providers (email providers, carriers, WhatsApp) that we don’t control. We can’t guarantee that every message will be delivered, or that the Service will always be available or error-free.

9. Ownership

You keep ownership of the content you add. You give us permission to store and process it only to provide the Service to you. The MyReminders name, logo, design and software belong to us.

10. Closing your account

You can delete your account at any time in the app (Settings → Delete account) or as described on our account deletion page. We may suspend or close an account that breaks these terms or puts other people at risk, and will tell you when we do unless the law prevents it.

11. Disclaimers and liability

The Service is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential losses, including missed or late messages or lost data, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim (or US$50 if you have not paid us). Nothing in these terms limits rights you have under consumer protection laws that cannot be excluded.

12. Changes to these terms

We may update these terms. We will post the new version here with a new date and, for significant changes, tell you by email or in the app before they take effect. If you continue to use the Service after that, the new terms apply.

13. Governing law and disputes

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Courts in Santa Clara County, California have jurisdiction over any dispute, except that if you are a consumer living elsewhere, you keep the protection of the mandatory laws of your country and may bring a claim in your local courts. Before going to court, please contact us so we can try to resolve the issue informally.
